I. DEFINITIONS:
Issuer - Piotr Piano Trading Company Ltd., Margerytki Street 12, 04-906 Warsaw, registered in the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, XIV Commercial Division of the National Court Register under KRS number 0000656388, Tax Identification Number (NIP): 9522155309, Business Identification Number (REGON): 366219315, operating the website at: "https://www.sterkowski.pl", "https://sterkowski.com", "https://sterkowski.de" and "https://sterkowski.es".
Online Store - the Issuer's online stores are located at "https://www.sterkowski.pl", "https://sterkowski.com", "https://sterkowski.de" and "https://sterkowski.es".
Gift Card - a physical or electronic voucher issued by the Issuer to the bearer with an individual identification number, the value of which corresponds to the nominal value indicated on it and which entitles the User to redeem it and make purchases of a specified amount in the Issuer's Online Store.
Purchaser - a person who receives a Gift Card from the Issuer in the Online Store in exchange for money.
User - any holder of the Gift Card.
Goods - items offered for sale in the Online Store.
II. GENERAL PROVISIONS
The Issuer allows the purchase of goods in the Online Store using Gift Cards. The Issuer undertakes to provide the Purchaser with a Gift Card, either in physical or electronic form, as chosen by the Purchaser, and to accept it for the purchase of Goods by Users in the Online Store under the conditions set out in these Terms and Conditions.
The Purchaser shall transfer funds to the Issuer in an amount equal to the value of the Gift Card. The amount of money transferred is equal to the value of the Gift Card provided by the Issuer to the Purchaser. The Purchaser can choose from the values of the Gift Card issued by the Issuer and available in the Online Store - 100 PLN, 150 PLN, 200 PLN, 250 PLN, 300 PLN, 350 PLN, 400 PLN, 450 PLN, 500 PLN (for the Online Store "https://www.sterkowski.pl"); 25 USD, 50 USD, 75 USD, 100 USD, 125 USD, 150 USD, 175 USD, 200 USD, 225 USD, 250 USD (for the Online Store "https://sterkowski. com"); 25 EUR, 50 EUR, 75 EUR, 100 EUR, 125 EUR, 150 EUR, 175 EUR, 200 EUR, 225 EUR, 250 EUR (for the online stores "https://sterkowski.de", "https://sterkowski.es", and "https://sterkowski.com"), and the funds allocated to the Gift Card can be used only in the online store. Payment for the Gift Card in the Online Store can be made only by traditional bank transfer, Przelewy 24, card payment, BLIK payment, Apple Pay, or Google Pay. A Gift Card cannot be purchased with another Gift Card.
The purchase and delivery of the Gift Card to the Purchaser may be made in the Online Store in either physical or electronic form.
The Gift Card purchased in Polish Zloty (PLN) is valid only in the store "www.sterkowski.pl", the Gift Card purchased in US Dollars (USD) is valid only in the store "https://sterkowski.com" and the Gift Card purchased in Euros (EUR) is valid only in the stores "https://sterkowski.com", "https://sterkowski.de" and "https://sterkowski.es".
The Purchaser or User is entitled to use the Gift Card issued by the Issuer to purchase any goods using the Gift Card in the Online Store during the validity period of the Gift Card up to the value of the Gift Card purchased.
The funds transferred by the Purchaser to the Issuer following paragraph 2 above become the full property of the Issuer at the moment the Gift Card is issued to the Purchaser.
Under no circumstances can the Gift Card be exchanged for cash (in any form), either in whole or in part. The return of a Gift Card purchased in the Online Store is subject to the terms and conditions of the Store, which are available on the website: https://www.sterkowski.pl/content/3-regulamin-sklepu. When making payments with the Gift Card, the User is not entitled to receive a change in cash if the value of the purchased goods is lower than the current nominal value of the funds registered on the Gift Card.
The Gift Card is a bearer card; therefore, if a transaction is made with the Gift Card by a User who obtained it in an unauthorized manner and the Issuer is not notified of this circumstance, such transaction shall be considered valid.
The purchaser or user shall have no claim against the issuer for the loss or destruction of the gift card for any reason. The issuer is not responsible for Gift Cards that are lost or damaged after delivery to the purchaser.
The Gift Card is valid from the date of purchase until the last day of the calendar year following its purchase (e.g., if the Purchaser purchases a Gift Card on August 20, 2023, it will be valid until the last day of the next calendar year, i.e., December 31, 2024), which is a minimum of 12 months. After this period, the Gift Card shall become invalid and the Purchaser or User shall not be entitled to a refund of the funds transferred by the Purchaser to the Issuer according to paragraph 2 above.
III. USE OF THE GIFT CARD
The Issuer accepts for use in the Online Store only valid and undamaged Gift Cards issued by the Issuer and bearing an individual identification number.
In order to use the Gift Card for payment in the Online Store, the Gift Card User must create a customer account on the Issuer's Online Store page and then add the Gift Card to the customer account by entering and confirming its unique code. Once the Gift Card has been correctly associated with the Customer Account, the Purchaser may use the available funds to purchase goods from the Issuer's Online Store and to cover shipping costs.
If the Purchaser or the User concludes a purchase agreement with the Issuer for goods by presenting a Gift Card for execution under the conditions set forth in these Terms and Conditions, the price owed to the Issuer for the goods in such case shall be reduced by the value of the Gift Card.
The Gift Card may be used more than once to pay for the selected products until the limit of funds allocated to it is exhausted. The current balance of the Gift Card can be checked by the User in his/her customer account in the online shop of the Issuer.
The Purchaser or the User is obliged to pay the difference in price in the Online Store if the value of the purchased goods is higher than the current nominal value of the Gift Card held.
If the price of the goods purchased with the Gift Card is higher than its face value, the Purchaser or User may use another Gift Card in the same transaction.
When purchasing goods from the Online Store, the funds on the Gift Card may also be used to pay for shipping of the goods purchased with the Gift Card. The purchaser may choose one of the available shipping options offered by the Online Store.
The Issuer has the right to refuse the execution of the Gift Card in particular, but not limited to, the following cases
a) the validity of the Gift Card has expired
b) the Gift Card is damaged to such an extent that it is impossible to identify the Gift Card, determine its validity period, etc.
IV. RETURN AND COMPLAINTS FOR GOODS PURCHASED USING THE GIFT CARD
In case of return of goods purchased in the Online Store using the Gift Card, the Purchaser or User will receive a refund for further purchases in the amount of the purchase price of the returned goods up to the balance of the Gift Card assigned to the customer account in the Issuer's Online Store.
Returns and complaints are carried out following the terms and conditions of the store, which are available on the website: https://www.sterkowski.com/content/terms-and-conditions.
The virtual funds on the Gift Card issued to the User at the time of returning the goods are subject to all the provisions of these Regulations.
In case of a complaint about the goods purchased in the Online Store using the Gift Card, the User is entitled to the rights specified in the Civil Code.

A Gift Card is not an electronic payment instrument, an electronic payment card, or a prepaid balance under applicable law. The Gift Card is solely a voucher for goods.
All matters not governed by these terms and conditions shall be governed by applicable law.
The Issuer reserves the right to amend these Terms and Conditions. The amended terms and conditions will be made available on the website referred to in point 1 above.
These Terms and Conditions shall be effective as of 01.11.2023.
